PREVENTIVE MAINTENANCE SERVICE TECHNICIAN GUIDELINES

When HJ Waterjet, Inc. (hereinafter referred to as the “Provider”) supplies the services of a service technician (hereinafter referred to as the “Technician”) to consult with and advise the Purchaser regarding the installation, start-up, overhaul, or maintenance of HJ Waterjet, Inc. equipment, the Technician shall not be responsible for procuring, supervising, or performing any labor or mechanical work carried out by others.

THE TECHNICIAN SERVICES SHALL BE FURNISHED UNDER THE FOLLOWING:


  • Utilities – The purchaser provides all necessary utilities at their expense.

  • Tools & Equipment – The purchaser supplies all tools and equipment needed for installation or service. Special tools brought by the technician remain the provider’s property. If too heavy for transport, the purchaser helps return them after service.

  • Reimbursement – The purchaser reimburses the provider for transportation costs of special tools (including a 15% surcharge) and replacement costs for any unreturned items.

  • Insurance – Technicians are covered by general liability insurance. The provider is not liable for losses that the purchaser can cover through their own insurance.

  • Access & Scheduling – Technicians will work consecutive days until the contracted work is complete. If denied access (except on national holidays), the purchaser will be invoiced for 8 hours at HJ Waterjet’s current rate plus living expenses.

  • Effort, Not Guarantee – Technicians will provide their best efforts to repair equipment, but no guarantee of full restoration is made.

  • Assignment – The provider may assign any portion of its contract performance to another professional service organization without purchaser consent.

  • Support Labor – The purchaser supplies all necessary labor (common, semi-skilled, skilled) and supervision at their expense. Support labor must be available during technician hours; technicians are not permitted to work alone.

  • Responsibility for Purchaser Materials – The provider is not responsible for materials or actions of the purchaser’s personnel, nor for delays, improper operation, or damage due to mishandling.

  • Limitation of Liability – The provider and its affiliates are not liable for consequential, incidental, indirect, special, or punitive damages, including lost profits, shutdown costs, or service interruptions. Total liability under this contract is limited to the purchase price of the services provided.

This contract ensures clear expectations regarding responsibilities, liability, and service terms, protecting both the provider and purchaser while defining costs, labor requirements, and coverage.
